2. Scope of the Terms
These Terms apply to electronic contracts concluded between the Service Provider and a visitor, customer or booking customer of the website (“Customer”). A consumer is a natural person acting outside their trade, profession or business activity.
Before finalising an order or booking, the Customer may review and accept the Terms and the Privacy Notice. The language of the contract is Hungarian. The contract is concluded electronically; the order and its data remain accessible in the Service Provider’s system for the applicable retention period, but the contract is not deemed to be in writing.
3. Electronic contracting
3.1. Ordering a product
- The Customer selects the product, specifies the desired quantity and adds it to the shopping basket.
- Before finalising the order, the quantity can be changed, items can be removed, and prices and expected costs can be reviewed in the basket.
- At checkout, the Customer provides billing, delivery and contact details, then selects from the available delivery and payment methods.
- Pressing the “Place order” button, or a button with equivalent meaning, constitutes an offer involving an obligation to pay.
- The system acknowledges receipt of the order in an automatic message. The contract is concluded when the Service Provider separately accepts the order or begins performance.
If the automatic acknowledgement is not received within 48 hours after the order is submitted, the Customer is released from their offer. In the event of an obviously incorrect price, lack of stock or an order that cannot be fulfilled, the Service Provider will initiate consultation or may reject the order; any amount already paid will be refunded.
3.2. Booking
An offer to book may be made based on the selected game session, date or room, number of participants, price and other conditions shown at checkout. The booking becomes final upon confirmation by the Service Provider. The Customer must provide accurate information and check the confirmation.
3.3. Data entry errors
Before submitting an order, the basket and checkout details can be amended. An error noticed after submission may be reported by the Customer without delay to taverna@potionvendor.hu at the following address.
4. Prices, payment and invoicing
Prices displayed on the website are gross amounts payable in Hungarian forints. The price of a product or service does not include any separately stated delivery charge. The total amount payable is shown before the order is finalised.
The payment methods actually available are always shown at checkout. These currently include in particular:
- bank transfer;
- cash on delivery, where available for the chosen delivery method.
The Service Provider may issue an electronic invoice, which the Customer receives at the email address provided. Invoicing may be carried out with the involvement of KBOSS.hu Kft., operator of the Számlázz.hu system.
5. Delivery and collection
Available delivery methods and exact charges are shown in the basket and at checkout. The contractual parcel-delivery partner is Paket 007 Kft.; delivery may be carried out through the GLS network. Available options may include home delivery, parcel locker, parcel shop and collection in person.
Collection in person is available at the place and time confirmed in advance. The Customer must provide delivery details that allow successful receipt.
The expected fulfilment time is stated on the product page, at checkout or in the confirmation. Unless otherwise agreed, the Service Provider fulfils the order without undue delay and no later than 30 days after the contract is concluded. The Customer will be notified in the event of a stock shortage or unforeseen obstacle.
The Customer is advised to check the parcel for damage upon receipt. In the event of visible damage, it is advisable to have the courier draw up a report and notify the Service Provider without delay. This does not restrict the Customer’s statutory rights.
6. Game sessions, room hire and other date-specific services
The booking applies to the date, number of participants, venue and service specified in the confirmation. Participants must comply with the house rules, safety requirements and reasonable instructions of the Game Master or venue staff.
6.1. Cancellation by the Customer
Before the scheduled start time:
- for cancellation at least 48 hours in advance cancellation is free of charge and the full amount paid is refunded;
- for cancellation between 24 and 48 hours in advance 50% of the amount paid is refunded;
- for cancellation within 24 hours or non-attendance no refund is available.
The deadline is calculated from the time the cancellation notice reaches the Service Provider. The cancellation must be sent to taverna@potionvendor.hu together with the information needed to identify the booking. The parties may also agree on another date.
6.2. Cancellation by the Service Provider
If the Service Provider cannot hold the booked session, it will either offer a new date or refund the full fee paid. The Service Provider is not liable for additional loss arising from circumstances beyond its control that could not reasonably be avoided, but will endeavour to notify the Customer promptly.
6.3. Right of withdrawal for date-specific services
For a leisure service provided on a specific date or during a specific period — including a game session or room hire for that purpose — the consumer does not have a 14-day right of withdrawal without giving a reason. The cancellation terms above apply instead.
7. Withdrawal from product purchases
A Customer who qualifies as a consumer may withdraw from a distance sales contract without giving a reason within 14 days after receiving the goods. Where several goods are delivered separately, the period begins upon receipt of the last item.
The withdrawal notice must be sent before the deadline expires:
Email: taverna@potionvendor.hu
Postal address: Ars Botanica Kft., 6120 Kiskunmajsa, Iparhegyi utca 41.
The consumer must return or hand over the goods within 14 days after notifying withdrawal. The direct cost of return is borne by the consumer. The Service Provider is not obliged to accept returns sent cash on delivery.
Within 14 days after becoming aware of the withdrawal, the Service Provider refunds the amount paid by the consumer, including the cost of the original least expensive standard delivery method. The refund may be withheld until the goods are returned or credible proof of return is provided. The consumer is liable for any diminished value resulting from use beyond what is necessary to establish the nature, characteristics and functioning of the goods.
7.1. Main exceptions to the right of withdrawal
The right of withdrawal may not be exercised in particular for goods made to the consumer’s instructions or express request, or clearly personalised goods; sealed goods that cannot be returned after opening for health-protection or hygiene reasons; or the fixed-date leisure services described in section 6.3.
7.2. Model withdrawal form
To: Ars Botanica Kft., 6120 Kiskunmajsa, Iparhegyi utca 41, Hungary; taverna@potionvendor.hu
I hereby give notice that I exercise my right of withdrawal in respect of the contract for the sale of the following goods:
Description of goods: …
Order number: …
Date of contract / receipt: …
Consumer’s name and address: …
Date: …
Signature (for a paper notice): …
8. Statutory warranty, product liability and guarantee
In the event of defective performance, the Customer has statutory warranty rights under the Hungarian Civil Code and the rules applicable to consumer contracts in force at the time. The consumer may primarily request repair or replacement, unless this is impossible or would involve disproportionate additional cost. Subject to the statutory conditions, a price reduction or termination of the contract may also be requested.
If movable goods are defective, the consumer may also bring a product warranty claim against the manufacturer or distributor. A mandatory guarantee applies only to durable consumer goods and under the conditions specified by law. Detailed terms of any manufacturer’s or voluntary guarantee are provided with the product.
The Customer may report the defect and claim to taverna@potionvendor.hu or at the Service Provider’s postal address. It is advisable to provide the order ID, a description of the defect and, if possible, a photograph.
9. Complaints and dispute resolution
The Customer may submit a complaint using the Service Provider’s contact details above. The Service Provider responds to a written complaint in writing and on its merits within the statutory time limit, generally within 30 days. If the complaint is rejected, the reasons and further avenues of redress will be provided.
In a consumer dispute, the consumer may apply to a conciliation board. The regional forum competent for the registered office of Ars Botanica Kft. is:
Csongrád-Csanád County Conciliation Board
Address: 6721 Szeged, Párizsi körút 8–12, Hungary
Phone: +36 62 549 392
Email: bekelteto.testulet@cskik.hu
Website: bekeltetes-csongrad.hu
The consumer may also apply to the conciliation board competent for their place of residence or stay; the current list is available at bekeltetes.hu . The Service Provider is required to cooperate in conciliation board proceedings.
The consumer may also apply to the consumer-protection authority or court competent for their place of residence. The European Commission’s former Online Dispute Resolution (ODR) platform was discontinued on 20 July 2025 and can therefore no longer be used.
10. Final provisions
The Service Provider may amend the Terms with effect for the future. An amendment does not affect contracts concluded earlier, unless permitted by law or by mutual agreement of the parties. The version in force when the contract is concluded applies to the order or booking.
Matters not regulated by these Terms are governed by Hungarian law, in particular the Hungarian Civil Code, Act CVIII of 2001 on electronic commerce services, Government Decree 45/2014 (26 February) on the detailed rules of contracts between consumers and businesses, and Act CLV of 1997 on consumer protection.
